Saltcoats man jailed for breach of non-harassment order

Desmond Nolan appeared for sentencing at Kilmarnock Sheriff Court in December after pleading guilty to four charges.

The 64-year-old admitted breaching a bail condition set in March last year not to approach or contact a woman. 

He did so on November 8 last year at Largs Railway Station and in the town’s Main Street, by communicating and approaching her. 

He also admitted breaching a non-harassment order (NHO) made in May 2021, which had been due to run for 10 years, to not contact or approach the woman and not to enter the village of Fairlie.

Nolan, of Donaldson Avenue in the Three Towns, also breached the NHO on November 8 last year, when he approached the same woman in Largs and at the railway station.

He was imprisoned for 12 weeks for the two NHO breaches, with his sentence being backdated to November 11 last year.

Sheriff Laura Mundell deferred sentencing on two other matters that he had previously pleaded guilty to.

This included breaching a separate non-harassment order made in September 2022, where Nolan was ordered not to contact or communicate with a woman. 

He broke this on February 27 and March 5 of last year at Nursery Place in Ardrossan, when he repeatedly phoned and communicated with her.

He also admitted breaking the previous NHO made in May 2021, when he contacted, approached and purchased alcohol for the woman in Nursery Place and in the town’s Asda store on February 27 and March 5 last year.

For those two charges, his sentencing was deferred until a later date.

Nolan’s solicitor Rebecca Horton told the court: “He is keen to break the cycle of offending and my invitation to you is to give him one final opportunity.”

Sheriff Mundell said: “There are a number of cases here and I recognise he has been in custody since November.

“I could sentence you to imprisonment. I am going to keep some cases alive.”
